We make reasonable efforts to ensure that information published on the Website is accurate and useful.
However, Website content is provided for general informational purposes and may change from time to time.
We do not guarantee that all information will always be:
- Complete;
- Current;
- Error-free;
- Available without interruption; or
- Suitable for every particular purpose.
Service descriptions, examples and portfolio materials are intended to demonstrate our capabilities and should not automatically be interpreted as a guarantee of a particular result.
5. Our Services
Information about our services on the Website is intended to help prospective clients understand our capabilities.
A description of a service on the Website does not automatically constitute a binding offer or agreement to provide that service.
A project becomes an agreed engagement only when the relevant requirements and commercial terms have been accepted by both Pro’ X47 Motion Studios and the client.
Depending on the project, the agreement may be established through a:
- Written quotation;
- Proposal;
- Statement of work;
- Service agreement;
- Invoice;
- Written project confirmation; or
- Other written agreement accepted by both parties.
6. Project Enquiries
You may contact us through the Website, email or other communication channels to discuss a potential project.
Submitting an enquiry does not guarantee:
- Acceptance of the project;
- Availability;
- A specific price;
- A specific delivery date;
- A particular production method; or
- A particular outcome.
We may request additional information before determining whether we can undertake a project.
7. Quotes, Proposals and Pricing
Where we provide a quotation or proposal, it will describe the applicable scope and pricing for the proposed work.
Unless expressly stated otherwise, pricing applies only to the work described in the agreed scope.
Additional charges may apply when a client requests work outside the original scope.
This may include:
- Additional revisions;
- Additional deliverables;
- Additional animation sequences;
- Substantial changes to an approved concept;
- Additional modelling or design requirements;
- New technical requirements;
- Additional rendering or production requirements; or
- Other significant changes requested after the project has commenced.
Where reasonably possible, additional work and associated costs will be communicated to the client before the additional work is undertaken.
8. Project Scope and Revisions
The agreed project scope determines what Pro’ X47 is responsible for delivering.
Where revisions are included, the number and nature of included revisions will be specified in the relevant proposal, quotation or project agreement.
A revision that substantially changes the original direction, concept or requirements may be considered additional work.
Approval of a concept, design, storyboard, model, animation or other milestone may affect the ability to request substantial changes without additional charges.
9. Client Responsibilities
Clients are responsible for providing information and materials reasonably required to complete their projects.
These may include:
- Product information;
- Brand guidelines;
- Logos;
- Images;
- Video footage;
- 3D models;
- CAD files;
- Technical specifications;
- Reference materials;
- Written content;
- Project requirements; and
- Other relevant materials.
Clients are responsible for ensuring that they have the necessary rights, licenses and permissions to provide such materials to Pro’ X47 Motion Studios.
Delays in providing required information, materials, feedback or approvals may affect project schedules.
10. Client Materials and Intellectual Property
Materials supplied by a client remain the property of the client or their respective owners.
By providing materials to Pro’ X47, the client grants us the permissions reasonably necessary to use those materials for the purpose of completing the agreed project.
The client represents that they have the necessary rights or authorization to provide those materials.
The client remains responsible for claims arising from materials supplied by them where they did not have the necessary rights or permissions.
11. Pro’ X47 Intellectual Property
Pro’ X47 Motion Studios retains ownership of its pre-existing intellectual property and independently developed production resources.
This may include:
- Production workflows;
- Techniques;
- Templates;
- Tools;
- Scripts;
- 3D assets;
- Reusable production components;
- Internal systems;
- Pre-existing designs;
- Know-how; and
- Other materials developed independently of a specific client project.
Payment for a project does not automatically transfer ownership of these underlying resources.
12. Ownership and Licensing of Final Deliverables
The ownership or licensing rights associated with final project deliverables will depend on the terms agreed for the individual project.
Where applicable, a project agreement may specify whether the client receives:
- Ownership of specified final deliverables;
- A license to use the deliverables;
- Commercial-use rights;
- Limited-use rights;
- Exclusive rights; or
- Other agreed rights.
Unless expressly agreed otherwise, source files, working files, production scenes, editable project files and underlying production assets are not automatically included with final deliverables.
13. Third-Party Materials and Services
Projects may involve third-party software, platforms, services, assets or technologies.
These may include:
- 3D software;
- AI production platforms;
- Rendering services;
- Plugins;
- Fonts;
- Music;
- Stock assets;
- Cloud services;
- Hosting services; or
- Other third-party technologies.
Third-party materials remain subject to their respective licenses and terms.
Pro’ X47 Motion Studios cannot transfer rights that it does not own.
Where a project requires a third-party license or paid service, the applicable cost or licensing requirement may be discussed with the client before use.
14. AI-Assisted Production
Pro’ X47 may use artificial intelligence and AI-assisted technologies as part of certain projects.
AI may be used for purposes including:
- Advertising production;
- Visual development;
- Image generation;
- Video generation;
- Creative exploration;
- Synthetic-data generation;
- Production assistance;
- Concept development; or
- Other agreed creative or technical applications.
AI-assisted production may be combined with human creative direction, 3D modelling, Blender-based production, animation, compositing, editing and other production techniques.
The use of AI does not mean that a project is produced entirely automatically.
Where specific licensing, ownership, disclosure or commercial-use considerations apply to AI-assisted materials, these may be addressed in the relevant project agreement.
15. 3D Printing
For 3D-printing projects, the quality and suitability of a finished part may depend on factors including:
- The supplied or developed 3D model;
- Dimensions;
- Material;
- Print orientation;
- Layer settings;
- Geometry;
- Tolerances;
- Intended use; and
- Post-processing requirements.
Clients are responsible for providing accurate specifications and identifying the intended application of the printed item.
Unless expressly agreed otherwise, 3D-printed parts should not be assumed to be certified or suitable for safety-critical, medical, structural or other regulated applications.
Where a component is intended for a specialized or safety-critical application, appropriate professional testing, validation and certification should be obtained.
16. AI Training and Synthetic Data
Where Pro’ X47 provides AI training data or synthetic-data services, the project requirements should establish the relevant technical specifications.
These may include:
- Dataset format;
- Image or video resolution;
- Object categories;
- Annotation types;
- Quantity;
- Camera configurations;
- Environmental variations;
- Object variations;
- Segmentation requirements; and
- Intended application.
Synthetic data can support the development and testing of AI and computer-vision systems, but Pro’ X47 does not guarantee a particular machine-learning model’s accuracy, performance or commercial outcome unless such a guarantee has been expressly agreed in writing.
The client remains responsible for determining whether a delivered dataset is suitable for its intended application.
17. Game Development
Game-development projects may involve design, programming, 3D assets, animation, environments, interfaces, sound, visual effects and other components.
The scope of each game-development project will depend on the agreed requirements.
Unless otherwise specified, the completion of one component of a game project does not necessarily imply completion of all other components.
Ownership and licensing of game assets, source code, project files and third-party components will be determined by the applicable project agreement.
18. Confidentiality
Where confidential information is exchanged, the parties may enter into a separate confidentiality agreement or NDA.
Where such an agreement exists, its terms will govern the handling of confidential information.
Clients should identify confidential or commercially sensitive information where appropriate.
Pro’ X47 will not knowingly disclose information that is subject to a valid confidentiality obligation except as permitted or required by the applicable agreement or law.
19. Portfolio and Promotional Use
Pro’ X47 may wish to showcase completed work as part of its portfolio, Website, presentations, social-media content or other promotional materials.
Where a project is confidential, subject to an NDA, commercially sensitive or otherwise restricted from public display, the applicable project agreement should establish those restrictions.
We will respect agreed confidentiality and publication restrictions.
Where appropriate, we may identify work as a client project, collaboration, demonstration or Pro’ X47-created project.
20. Project Timelines
We will make reasonable efforts to meet agreed project timelines.
Project schedules may be affected by:
- Delays in receiving client materials;
- Delays in receiving feedback or approvals;
- Changes to project scope;
- Additional revision requests;
- Technical problems;
- Third-party service interruptions;
- Unexpected production requirements; or
- Circumstances beyond our reasonable control.
Where a significant delay occurs, we will communicate with the client as reasonably practicable.
21. Payments
Payment terms will be specified in the applicable quotation, invoice, proposal or project agreement.
Depending on the project, payment arrangements may include:
- Upfront deposits;
- Milestone payments;
- Progress payments;
- Payment upon completion; or
- Other mutually agreed arrangements.
The applicable payment schedule will be agreed before or during project commencement.
22. Cancellation and Termination
Either party may request cancellation or termination of a project subject to the terms of the applicable project agreement.
If a project is cancelled after work has commenced, the client may be responsible for:
- Work already completed;
- Approved expenses already incurred;
- Non-refundable third-party costs; and
- Other amounts specified in the applicable project agreement.
Specific cancellation, refund and termination provisions may vary according to the project.
23. Refunds
Any refund entitlement will depend on the nature of the service, the stage of the project and the terms agreed between Pro’ X47 and the client.
Where a project agreement contains specific refund provisions, those provisions will apply.
Nothing in these Terms is intended to remove consumer rights or other mandatory protections that cannot lawfully be excluded.
24. Third-Party Links
The Website may contain links to third-party websites, platforms or services.
These links may be provided for convenience, reference or informational purposes.
Pro’ X47 does not control third-party websites and is not responsible for their:

- Services.
Your use of a third-party website is governed by that third party’s own terms and policies.
25. Website Availability and Security
We make reasonable efforts to maintain the security and availability of the Website.
However, we do not guarantee that the Website will always be:
- Available;
- Secure;
- Error-free;
- Free from interruptions; or
- Free from harmful third-party activity.
The Website may occasionally be unavailable because of maintenance, updates, hosting issues, security measures, technical failures or circumstances beyond our reasonable control.

Nothing on the Website constitutes professional legal, financial, medical, engineering or other regulated professional advice unless expressly stated otherwise.
Where a product, printed component, dataset, animation, simulation or other deliverable is intended for a specialized or safety-critical application, the client is responsible for obtaining appropriate professional testing, validation, certification or approval.

Unless expressly agreed in writing, we do not guarantee specific business results, including:
- Sales;

28. Limitation of Liability
To the maximum extent permitted by applicable law, Pro’ X47 Motion Studios will not be liable for indirect, incidental, special, consequential or unforeseeable losses arising from the use of the Website or our services.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

32. Applicable Law and Jurisdiction
Pro’ X47 Motion Studios operates remotely and works with clients internationally.
The laws and regulations applicable to a particular client relationship may depend on factors including the location of the parties, the nature of the services, applicable mandatory consumer protections and the terms of the specific project agreement.
Where appropriate, the applicable law, jurisdiction and dispute-resolution process will be established in the relevant quotation, proposal, statement of work, service agreement or other written agreement between Pro’ X47 Motion Studios and the client.
Nothing in these Terms is intended to deprive a consumer or other protected party of mandatory rights or protections available to them under the laws applicable to their circumstances.
